Job Title: Senior Counsel, Digital First Banking

Location: Atlanta, GA (hybrid)

Position Summary

Senior Counsel – Digital First Banking works in a dynamic and collegial team of attorneys and contract managers. This position reports to the Chief Counsel – Digital First Banking and provides support for NCR’s growing Digital First Banking line of business, globally. Responsibilities will include: advising business clients on engagement-relevant fintech industry legal issues; providing engagement-relevant, risk-balanced legal evaluation on financial services regulatory compliance, data security and privacy issues; negotiating cloud and license agreements for both sales and procurement for resale; assisting with developing contract templates; and identifying legal risks, conflicts and issues relevant to the business supported in various engagements.

KEY AREAS OF RESPONSIBILITY:

  • Advise business clients with respect to fintech, financial institution technology service provider, and compliance legal issues in the area of digital banking on engagements;

  • Negotiate and review cloud, services, licensing and related agreements, individually and working with other contract professionals;

  • Exercise judgment in advising business clients on contract interpretation;

  • Provide issue-focused legal guidance to contract managers on an escalation basis;

  • Work with others internally such as marketing, product management, product development, pricing and finance, along with legal subject matter experts in-house and externally, to support day-to-day product guidance and product management needs;

  • Maintain in-depth knowledge of NCR's procedures, processes, and policies; and

  • Analyze and interpret law, rulings, and regulations that affect the business and provide practical advice in response relative to engagements.

BASIC REQUIREMENTS & EXPERIENCE:

  • Graduate of a well-regarded law school;

  • Minimum of 5 years’ licensed legal experience in financial services technology law that must have included commercial transactions, technology, and data privacy law – preferably with primarily in-house experience;

  • Ability to work on a lean team serving a face-paced, high-visibility business while keeping a cool head and an eye toward successful outcomes that properly balance the business objectives with reasonable risk positions developed in concert with the business; requires:

  • Knowledge of technology contract laws and practices within the digital banking industry;

  • Familiarity with privacy law (including GDPR and CCPA), cybersecurity matters, and how those areas interface with digital banking businesses;

  • Knowledge of regulatory law applicable to financial institutions and vendors to financial institutions including GLBA, BSA, AML and KYC;

  • Excellent communication skills with ability to effectively negotiate in demanding circumstances;

  • Strong writing skills and attention to detail;

  • Ability to work under short deadlines and outside normal working hours with minimal advance notice and minimal supervision; and

  • Conceptual and critical thinking skills in complex/completely novel situations and ability to communicate ideas effectively.

  • Confidence and efficacy in client- and customer-facing situations, presenting a positive and professional image; excellent interpersonal skills; and

  • May require limited domestic and international travel.
