Lead Counsel - Employee Benefits Location: Dallas, TX; Atlanta, GA; Columbus, OH; Richmond, VA (REQUIRED) Experience: 10 years+ The Role The Employee Benefits Lead Counsel will be responsible for a range of enterprise-wide work relating to advising McKesson on global health and welfare plan compliance, design, risk and participant claims and appeals. Key Responsibilities Provide legal advice on self-funded health plans, disability plans, severance plans, flexible spending accounts, wellness programs, PBM agreements, Section 125 plans, health savings accounts, insured disability and life/AD&D plans and educational assistance programs Draft and maintain official plan documents and Summary Plan Descriptions for McKesson ERISA health and welfare plans, including, but not limited to, self-insured medical, dental and vision plans, multiple employer welfare plans ("MEWAs"), Section 125 "cafeteria" plans, flexible spending accounts, life insurance and AD&D plans, long-term/short-term disability plans, severance pay plans and retiree HRA plans Draft and negotiate pharmacy benefit manager (PBM) contracts Provide day-to-day support to business personnel regarding operational and compliance matters and resolution of client issues Advise on potential health and welfare plan litigation and compliance with recent changes in the law, including but not limited to, the Consolidated Appropriations Act and final Transparency in Coverage rule Draft, maintain and, if applicable, negotiate legal agreements, such as plan documents, summary plan descriptions, ASO/recordkeeping agreements and insurance agreements Provide benefits legal advice in connection with McKesson mergers and acquisitions, including health and welfare plan due diligence and drafting benefits provisions in purchase agreements and disclosure schedules Willing to receive training in the Executive Compensation area Must be authorized to work in the US. This is determined by several factors, including performance, experience and skills, equity, regular job market evaluations, and geographical markets. In addition to base pay, other compensation, such as an annual bonus or long-term incentive opportunities may be offered.
